Pro Armour Limited Warranty

Pro Armour warrants to the original purchaser that this product is free from defects in materials and workmanship. This warranty does not apply if this product (1) was not purchased from Pro Armour or an authorised Pro Armour dealer or distributor, (2) has been altered in a way, or (3) has not been used in accordance with any disclaimers, warnings and instructions provided with or in relation to the product. This Limited Warranty does not cover damage due to accidents, neglect, misuse, operation beyond capacity, or damage by improper application, that in Pro Armour’s judgment materially or adversely affects the product.

 

The duration of this Limited Warranty is 6 months, and is effective from the date of delivery to the purchaser. Pro Armour’s sole obligation under this Limited Warranty is to either repair or replace the product at no charge, or to credit the purchaser’s account for the value of the defective product at Pro Armour’s sole discretion.

 Pro Armour is not a provider of medical services and is not a medical professional, and does not provide any advice, warranties or representations about the appropriateness or suitability of the product for any person. All such warranties and representations are expressly disclaimed. In particular, users of the product should consult with their own health care professionals about such matters, or if they have any questions about how the product might apply to their specific medical condition. Users of the product should also immediately consult with a health care professional if they experience any adverse medical reactions following use of the product. The use of the product is not a guarantee against injury.

 

Limitations and exclusions of liability

 To the maximum extent permitted by law:

  • Pro Armour disclaims and excludes any other express or implied warranties not set forth in this Limited Warranty, including but not limited to warranties of merchantability or fitness for a particular purpose; and
  • this Limited Warranty excludes liability for any personal injury, property damage, or special, incidental, or consequential damages arising out of, related, or incident to use the product, even if Pro Armour has been advised of the possibility of such potential loss or damage.

 

Consumer law protections

 Consumer laws in some countries may give consumers legal rights and remedies in relation to the products that are additional to the rights and remedies provided under this Limited Warranty, and that cannot be contracted out of (Consumer Laws). Any rights or remedies you may have against Pro Armour under the Consumer Laws are in addition to any rights and remedies you have under this Limited Warranty.

 

Nothing in this Limited Warranty purports to modify or exclude any of the conditions, warranties and undertakings, and other legal rights or remedies you may have as a consumer, under the Consumer Laws.

 

Specific consumer law protections for New Zealand and Australian customers

 The Consumer Guarantees Act 1993 (New Zealand) and the Competition and Consumer Act (2010) (including the Australian Consumer Law) (Australia) (together the NZ/AU Consumer Laws) give consumers in those countries certain legal rights and remedies in relation to the quality and fitness for purpose of products sold in those countries.

 

The NZ/AU Consumer Laws include a guarantee that products will be of acceptable quality. You may have rights and remedies against Pro Armour in relation to the product if you acquired the product as a “consumer” under the applicable NZ/AU Consumer Laws.

 

Any rights or remedies you may have against Pro Armour under the NZ/AU Consumer Laws are in addition to any rights and remedies you have under this Limited Warranty. Nothing in this Limited Warranty purports to modify or exclude any of the conditions, warranties and undertakings, and other legal rights or remedies you may have as a consumer, under the NZ/AU Consumer Laws.
